If you are under arrest then you are likely to have been cautioned. This means that you do not have to say anything but if you fail to mention anything which you may later rely on in your defence then the Court may draw an adverse inference. This means that the Court may hold it against you if you do not say anything about your defence.
The caution is as follows:
"You do not have to say anything. But it may harm your defence if you do not mention when questioned something which you later rely on in court. Anything you do say may be given in evidence."
