Investigation & Arrest AdviceAt Kaim Todner we cover all areas of Criminal Law and undertake every aspect of investigatory and procedural work. If the police suspect you of having been involved in a criminal offence they can arrest you or request you voluntarily attend a police station in order to be formally interviewed on tape and under caution. If you are arrested, you must be cautioned and informed you have the right to free and independent legal advice. We have a 24 hour Call Centre that is available to respond to any emergency situation at short notice. If you attend as a volunteer and are to be formally interviewed on tape, you must be cautioned and informed that you have the right to free and independent legal advice. You must also be told that you are not under arrest and can leave the police station at any time. If you are invited to attend the police station to be interviewed, please feel free to contact us on 0207 353 6660. We can arrange for a representative to accompany you to the police station at short notice. When you are to be formally interviewed on tape by the police you will be cautioned. The caution is as follows: "You do not have to say anything, but it may harm your defence if you do not mention when questioned something which you later rely on in Court. Anything you do say may be given in evidence". The caution can be explained like this:
That is why it is important for you to have the best advice at an early stage: it could prevent you from being charged, but if charged, could prevent you from being convicted. Remember, everyone has the fundamental right to free and independent legal advice at the police station irrespective of their income or means.
